Acceptance of Terms
AppThemes provides software and website services to you subject to the following Terms of Service (TOS), which may be updated from time to time without notice. When using any particular AppThemes owned or operated services, you and AppThemes shall be subject to any posted guidelines or rules applicable to such services. All such guidelines or rules are hereby incorporated by reference into the TOS.
Product License
All our WordPress themes are licensed under the GNU general public license. This does not mean our products are free. Customers must first purchase our products and then they may use them on as many websites as they like. Support and customer accounts are only available to those who purchase our products.
Photoshop Files License
The Photoshop design files of our themes do not fall under the GPL license. They are licensed and copyrighted under AppThemes which means you are not allowed to redistribute, repackage, sell, etc these files in any way. Doing so will violate our TOS and permanently lock your customer account. No exceptions.
Product Compatibility
AppThemes is committed to keeping all themes up-to-date and working with the latest version of WordPress. Our themes are developed for WordPress 3.0 or higher and any version prior to that may have problems with some theme functionality.
Refund Policy
AppThemes provides digital media (software) that can be downloaded instantly after a purchase has been made. There is no “trial” or “grace period” after purchasing our themes which means all sales are final. Once you have our software, there is no way to “return” it.
Product Support
AppThemes’ products and designs are provided “as is”, with no implied meaning that they will function exactly as you wish or with all 3rd party components and plugins. We do however, offer support via our forums which is moderated by our team of support representatives. No support will be provided via email. Support also does not cover installation, customization, and/or administration of WordPress itself.
Product Updates
Each individual product purchased from AppThemes includes free updates to customers. We do not guarantee that product updates will always be made and forever, but AppThemes does it’s best to improve each product over time and make sure they will work with the latest version of WordPress. We cannot guarantee that our themes will run with older versions of WordPress (3.0 or earlier).
Software Modifications
You are free to make any changes and/or modifications to our products to suit your needs. This includes all PHP, JavaScript, HTML and CSS files distributed with our products. Please note, that once you make changes to our products, it’s voids your product support since troubleshooting and debugging makes it very difficult due to your changes. You are still free to post your questions in the support forums as other customers may still be willing to assist you.
Customer Accounts
You will be required to create a customer account when purchasing any of our products and/or services. You are responsible for maintaining the confidentiality of your password and are not permitted to share and/or distribute your customer account login details. You are fully responsible for all activities that occur under your account and agree to immediately notify AppThemes of any unauthorized use of your customer account or any other breach of security. AppThemes will not be liable for any loss or damage arising from your failure to comply with these terms.
Account Termination and Suspension
AppThemes reserves the right to suspend and/or terminate any user account without notice. No refunds will be provided to existing customers who have their accounts terminated. This may be due to one or several of the following reasons. 1) Abusive behavior and/or excessive negativity towards the AppThemes staff and/or other AppThemes customers. 2) Repeated defamatory, malicious, and/or false statements including slander against AppThemes, and/or attempts to persuade potential customers away from purchasing AppThemes products. 3) Promoting competitor products, contributing to software piracy, hacking, spamming, or other illegal acts. 4) We reasonably believe that your account has been compromised, shared with others, or for other security reasons. All decisions are final and accounts terminated or suspended will not be reversed.
Software Ownership
You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are property of AppThemes. Our products are provided “as is” without warranty of any kind, either expressed or implied. In no event shall AppThemes be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.
Product Delivery
After we have successfully received your payment, your AppThemes customer account login information will be emailed to the email address you provided. This may take up to 30 minutes after purchase but usually happens within 5-10 minutes. Purchases made via e-check take anywhere from 3-7 days to clear before you will have access to download your purchase(s). If you do not wish to wait that long, make your purchase via credit card or PayPal funds.
Price/Product Changes
AppThemes reserves the right at any time to modify and/or discontinue a product with or without notice. Further, we may add new products and/or services with or without notice. Prices of any products are subject to change at any time by posting the changes to the AppThemes website.
Product Warranty
AppThemes does not warranty or guarantee that our products will work with all 3rd party plugins or other custom development done with WordPress. We do guarantee that our products will work fine with the latest version of WordPress and MySQL and no plugins running.
Privacy Policy
User account data and certain other information about you will never be sold or rented to any third-party without your permission first. You understand that through your use of our services you consent to the collection and use of this information which includes the transfer of this information to the United States and/or other countries for storage, processing and use by AppThemes.
